Terms & Conditions

All prospective bidders must register to bid. A 10% Buyers Premium will be added to the final bid price to constitute the final selling price. If you are the high bidder on the entire golf course (Tracts / Lots 1-15, 220 +/- acres) you as the high bidder must put a down payment of $50,000 non-refundable deposit. If you are the high bidder on the individual proposed tracts/ lots you must put a $5,000 non-refundable deposit per lot. All deposits go towards your down payment. All checks shall be made payable to Ohio Real Estate Auctions LLC. and will be deposited in their Trust Account.

You must close on the property on or before June 20, 2016. The successful high bidder will be required to sign the Real Estate Purchase Agreement immediately upon conclusion of the bidding. The Buyer will be responsible for all the closing cost, six month accrued taxes, survey cost and soil test. The property will be sold via seller’s acceptance and is selling “As Is Where Is”, all inspections shall be completed prior to the auction. The buyer is buying the property with no contingencies. Upon the Auctioneer posting the high bid and or saying sold at the auction the buyer is required to sign a purchase agreement. This purchase agreement shall be made visible at the auction and will be given prior at the prospective buyer’s request. Failure to execute these documents under the terms and conditions will result in the buyer forfeiting all of the deposit money as damage. All and any other terms and conditions that are announced the day of auction will take precedence over all printed material.

Each Tract / Lot (1-15) will be assessed a $350.00 survey fee that will be due at closing. Tract / Lots Numbers 8, 9, 11, 12 & 13 will be assessed $350.00 for the soil test that was completed for those lots that will also be due at closing. The closing of the property will take place at Lawyers Title 147 Main Street Chardon, Ohio 44024 through Debbie Mack

The Seller / Title Company shall provide a legal marketable deed along with any assessment stated above prior to the closing of the properties.

Registration: Bidder registration will start at 3:30 pm on Thursday May 5, 2016. All bidders are required to register and provide a State ID an or Passport prior to the auction. Auction Company reserves the right to decline registration if suitable information is not provided.

Bidder Number: All bidders are required to use the bid number issued to them for the purpose associated with this auction.

Forfeiture upon Default: In such event the buyer fails to abide by the terms and conditions set forth herein or fails to abide by the obligations arising from the purchase and sale contract executed in conjunction with this sale, buyer acknowledges they shall forfeit all monies deposited.
